Terms & Conditions
These terms and conditions apply to the supply of products and treatments made by us but may be subject to change at our discretion as updated on our website. These terms and conditions are subject to your rights under the Consumer Guarantees Act 1993.
1. TREATMENT TIMES
1.1 Please arrive five minutes prior to your scheduled appointment to allow for a relaxed check in and for preparation prior to your treatment.
1.2 Treatments must start and finish at the scheduled time to accommodate all clients. If, for any reason, the start time of your treatment is delayed and you have arrived on time, we will endeavour to provide you with your full treatment.
1.3 We will do our best to start your treatment at the scheduled time but will not be liable for any delays.
2.1 If you need to cancel or reschedule your appointment, please give us not less than 24 hours notice prior to your treatment (or 48 hours notice if your treatment is more than two hours). Appointments cancelled with less notice or “no shows” may result in a charge of 25% of the cost of your treatment.
2.2 Prior to your treatment, we will endeavour to send you a text message, or email, or we will telephone you to remind you of your appointment time. The method of communication that we will use will depend on your preferred contact method (as indicated to us).
3. MOBILE PHONES
3.1 We ask you that you please turn off your mobile phone upon arrival at the spa to ensure that your treatment (and those of other clients) is relaxed and enjoyable.
4.1 It is important that we are fully aware of all medical and health conditions before commencing any new treatment. You agree that, prior to your treatment (and any subsequent treatment), you have disclosed all relevant medical and health conditions (including pregnancy, allergies, heart conditions, injuries and all skin conditions). If you are unsure whether or not a health or medical condition is relevant, you agree to discuss this with your therapist prior to the treatment commencing.
5. GIFT VOUCHERS
5.1 Gift vouchers are available for any specific treatment or any dollar value. All vouchers have a [ twelve ] month expiry. Vouchers are non-refundable.
6.1 While we will do our best to accommodate your request for a particular therapist, we cannot always guarantee that a particular therapist will be available and we reserve our right to provide a substitute therapist without notice.
7. RIGHT TO REFUSE TREATMENT
7.1 We endeavour to treat all our clients with dignity and respect and we expect our staff to be treated in the same manner. We reserve our right to refuse to provide services where staff are treated inappropriately.
8. ACCESS AND CAR PARKING
8.1 Access to the spa during the garden centre business hours is via the Palmers Garden Centre.
8.2 If your treatment is scheduled outside of the garden centre business hours, you will be given a passcode to the back gate and rear access to the spa.
8.3 Customer car parking is available in the garden centre car park. If you park your vehicle in the customer car park, you do so at your own risk. We do not accept any liability if your vehicle is damaged or stolen in the car park or in the driveway access.
9.1 If you are not satisfied with your treatment, please immediately notify us. If the treatment has not been carried out with reasonable care and skill, we will either (at our option) provide you with a refund or arrange for another treatment to be carried out free of charge.
1. RETENTION OF TITLE
1.1 All products supplied by us remain our property until they have been paid for in full by you.
2. REFUNDS AND RETURNS
2.1 If you have a concern or complaint regarding any products that you have purchased from us, please immediately notify us to complete our Product Complaint Form. If the product is not of reasonable acceptable quality, we will either (at our option) provide you with a credit note for the cost of the product or provide you with a replacement product.
2.2 In certain circumstances we may (at our complete discretion) be able to provide you with a credit note if you change your mind about a product. The product must have been sold to you less than 30 days ago and must be unopened, unused and in a condition for resale.
1. PAYMENT TERMS
1.1 Your treatment must be paid for in full at the end of your treatment. Payment is accepted by either cash, eftpos or credit card.
1.2 All our price lists include GST and are subject to change without notice.
1.3 Products must be paid for in full before they are removed from the spa.
1.4 If you fail to pay your account on time:
(a) We may, at our discretion, charge you interest on the unpaid overdue balance from the day after payment is due until the day payment is received (including that day) at the rate of 5% per annum above the current commercial overdraft rate charged by our bank.
(b) You will pay our cost of recovery or costs incurred by us in the enforcement (or attempted enforcement) of our rights under these terms and conditions (including our legal costs on a solicitor/client basis). In the event of legal action, you will pay continuing interest after the date of the judgment order or award until full payment is received by us.
2. LIMITATION OF LIABILITY
2.1 To the extent permitted by law, our liability whether statutory, in contract or tort or otherwise shall be limited to (at our option) either the replacement of the product or treatment, or to the value of the product or treatment supplied to you. We will not be liable for any personal injury or damage to property which is in anyway connected to your treatment or to products supplied by us.
3.1 We are committed to protecting your privacy and respect your rights to privacy under the Privacy Act 1993. We comply with our statutory obligations in respect of the collection, use, disclosure, storage and handling of your personal information.
3.2 Your personal contact details, credit card information and other personal information that we hold about you is to be used solely for our purposes (including administering these terms and conditions and marketing our products and treatments).
3.3 Where information can be readily retrieved, you will have the right to access it, request any corrections and the right to be notified of action taken in response to any such request (subject to the payment of a reasonable charge).
3.4 You acknowledge that we may from time to time email you news on our special offers, features and services. You can opt out of such email communications at any time by clicking on the unsubscribe feature located on the email or by replying to our email with the word “unsubscribe” in the subject line.
3.5 You acknowledge that if Tonic Skin and Beauty Care Limited business is sold, any personal information in our possession maybe transferred to the purchasing entity.
